DUI for sleeping

Do you know that to be sleeping in your car in a parking lot can get you a DUI?
Well it can. I would think that if you decide to sleep instead of get behind the wheel while drunk especially if the police van see you have not moved from the spot that you started in. You should get a metal not thrown in prison.
My brother is in prison right now going on a year because he chose to sleep instead of driving. He pleaded down to reckless driving which now they count that as a violent offense. This law needs to be changed. He was trying to obey the law and now it is ruining his life.

I have a question to clarify as to understand what you are claiming. Was his car parked in a place where he would not have been an obstacle for other drivers and was the car on or off? Those factors play a big role in how the situation should have played out.
