Nevada’s prior appropriation framework was built around historic agricultural patterns. Water rights are tied to historic crop type, diversion volume, acreage, and beneficial use doctrine ('use it or lose it'). This structure unintentionally incentivizes maximum diversion rather than efficiency and discourages voluntary reductions in consumptive use. Need to reframe agricultural productivity in terms of value per acre-foot rather than volume diverted, and removing risk of forfeiture to those who undertake more water efficient yet still economically productive, agriculture production. This grounded water reform provides a voluntary, private market driven with no taxpayer dollars, allows flexibility and ultimately reduction in red tape, and anyone who uses less water is a benefit to every other water user in the system.
