workmans comp aging out

my husband was injured at work. His attorney explained to us that the $$ is capped to an amount as if he was 70. he will be 74 in May. The legislation has to be submitted and approved by the state to allow appropriate amounts to be awarded to people over 70. at the time the legislation was passed, people over70 did not work please dig into this issue and see if we can get new legislation passed. we have many working in our great state the that are way over70.
